Acceptance of Terms
By downloading, installing, or using Select 5 ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
Eligibility
You must be at least 18 years of age to use Select 5. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
We reserve the right to request proof of age at any time and to terminate accounts that do not meet the age requirement.
Your Account
To use Select 5, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information in your profile. Misrepresenting your identity, age, or using someone else's photos is strictly prohibited and may result in immediate account termination.
Community Guidelines & Acceptable Use
Select 5 is a community built on respect and genuine connections. We have a zero-tolerance policy for objectionable content, abusive behavior, and any form of harassment. When using the App, you agree not to:
• Harass, bully, intimidate, or threaten other users
• Post content that is illegal, sexually explicit, hateful, discriminatory, violent, or otherwise objectionable
• Share or upload obscene, pornographic, or offensive material
• Impersonate any person or entity, or use fake profiles
• Solicit money or promote commercial activities to other users
• Send spam, unsolicited messages, or engage in scam behavior
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use bots, scrapers, or automated methods to interact with the App
We take violations of these guidelines extremely seriously. Any user found to be in violation will have their account suspended or permanently terminated, and their content will be immediately removed from the platform.
Content Moderation & Filtering
Select 5 employs a combination of automated systems and human review to filter and moderate user-generated content. Our content moderation measures include:
• Automated Filtering: We use automated tools to detect and filter objectionable content, including but not limited to explicit imagery, hate speech, spam, and other content that violates our community guidelines.
• Human Review: Our moderation team reviews flagged content and reported users to ensure compliance with our policies.
• Proactive Monitoring: We proactively monitor user-generated content to identify and remove objectionable material before it reaches other users.
While we strive to maintain a safe environment, no content moderation system is perfect. We encourage all users to report any content or behavior that violates our guidelines.
Reporting Objectionable Content
Select 5 provides built-in mechanisms for users to report objectionable content and abusive behavior. You can report content or users directly within the App by:
• Tapping the report button on any user's profile
• Tapping the report button within any conversation or message
• Contacting our support team at info@select5.app
All reports are taken seriously and are reviewed promptly. We commit to acting on all objectionable content reports within 24 hours. When a report is substantiated, we will remove the offending content immediately and take appropriate action against the user who provided it, up to and including permanent account termination.
Blocking Abusive Users
Select 5 provides a built-in blocking feature that allows you to block any user at any time. When you block a user:
• The blocked user's content is instantly removed from your feed and you will no longer see their profile, messages, or any other content from them.
• The blocked user will not be able to view your profile, send you messages, or interact with you in any way.
• Our team is automatically notified of the block and any associated inappropriate content so we can review the reported user's behavior.
• If the blocked user is found to have violated our community guidelines, we will take action within 24 hours, which may include removing their content and permanently terminating their account.
You can manage your blocked users list at any time through the App settings.
User Content
You retain ownership of content you create on Select 5 (such as your profile, photos, music selections, and messages). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App.
You are solely responsible for the content you post and you agree that all content you post complies with these Terms and our community guidelines. Any content that is objectionable, abusive, or violates our guidelines will be removed, and the user responsible may be permanently banned from the platform.
Do not share personal information like phone numbers, addresses, or financial details in your profile or messages.
Matching & Interactions
Select 5 matches users based on music taste compatibility. While we strive to provide meaningful matches, we do not guarantee that you will find a compatible partner through the App.
You acknowledge that interactions with other users are at your own risk. Select 5 does not conduct criminal background checks on its users. Always exercise caution when meeting someone in person for the first time.
Subscriptions & Payments
Select 5 offers optional premium subscription plans that provide enhanced features. By purchasing a subscription, you agree to the following:
Billing: All subscriptions are billed through Apple's App Store (via your Apple ID) or Google Play Store. Payment is charged to your account upon confirmation of purchase. Subscription pricing is displayed in the app and may vary by region.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.
Free Trials: We may offer free trial periods for premium features. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription at the advertised rate.
Cancellation: You can cancel your subscription at any time through your device's subscription settings (Settings > Apple ID > Subscriptions on iOS, or Google Play Store > Subscriptions on Android). Cancellation takes effect at the end of the current billing period — you will continue to have access to premium features until then.
Refunds: All payments are processed by Apple or Google. Refund requests must be submitted directly to Apple (reportaproblem.apple.com) or Google Play. We do not process refunds directly. Refund eligibility is determined by the respective platform's refund policy.
Price Changes: We may change subscription pricing at any time. Price changes will take effect at the start of the next billing period following notice. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
Intellectual Property
Select 5, including its design, logo, matching algorithm, features, and content (excluding user-generated content), is owned by us and protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the App or its content without our written permission.
Disclaimers
Select 5 is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, secure, or error-free.
We are not responsible for any content posted by users or for the behavior of users on or off the platform. We do not verify the accuracy of user profiles or representations.
Limitation of Liability
To the fullest extent permitted by law, Select 5 and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the App or interactions with other users.
Our total liability for any claim related to the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
Termination
We may suspend or terminate your access to Select 5 at any time, with or without cause, with or without notice — particularly if you violate these Terms or our community guidelines. You may also delete your account at any time through the App settings.
Users who post objectionable content or engage in abusive behavior will be ejected from the platform. We act on all content reports within 24 hours, and substantiated violations will result in immediate content removal and account termination.
Upon termination, your right to use the App will cease immediately, your content will be removed, and your profile will no longer be visible to other users.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
Informal Resolution: Before filing any formal legal action, you agree to first contact us at info@select5.app and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved quickly through direct communication.
Binding Arbitration: If we cannot resolve a dispute informally, you and Select 5 agree to resolve any claims relating to these Terms or the App through final and binding arbitration, rather than in court. Arbitration shall be administered by a recognized arbitration body and conducted in English. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found to be unenforceable, the entire arbitration agreement shall be void.
Exceptions: Either party may bring claims in small claims court if eligible. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
End-User License Agreement (EULA)
Select 5 grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial purposes and in accordance with these Terms.
You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App; (c) rent, lease, lend, sell, sublicense, or transfer the App to any third party; (d) remove, alter, or obscure any proprietary notices on the App; or (e) use the App for any illegal or unauthorized purpose.
This license is effective until terminated. It will terminate automatically if you fail to comply with any term of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
The App is licensed, not sold, to you. Select 5 retains all rights, title, and interest in the App not expressly granted herein.
Privacy Policy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information when you use Select 5. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy.
The Privacy Policy is incorporated into and forms part of these Terms & Conditions.
